In the event of infringement of his rights, the copyright holders (the author and the company who acquired the exploitation rights) have the right to take action for infringement. They may exercise either before civil or administrative courts to obtain compensation, or before the criminal courts to obtain criminal sanctions.
The intellectual property code means by counterfeiting all acts of use not authorization of the work. The law criminalizes under the offense of counterfeiting: - “any reproduction, representation or distribution, by any means whatsoever, of a work of mind in violation of the author's rights, as defined and regulated by law" (ICC, art. L. 335-3).
In the event of partial recovery of the latter, it is assessed according to the similarities between the works.
